Compton Harry Photography
Terms & Conditions
These terms apply to every booking with Compton Harry Photography, from headshots and personal branding sessions to events, brand content and podcast recordings. Your quote or booking confirmation sets out the details of your job, including the date, location, fee and licence; these terms cover everything else.
1. About these terms
1.1 "Photographer" means Compton Harry Photography, its owner, employees and subcontractors.
1.2 "Client" means the person, business or organisation named on the Booking Confirmation.
1.3 "Booking Confirmation" means the quote, estimate or booking confirmation for the job, including any Job Schedule attached to it.
1.4 "Works" means all photographs, video, audio, podcast recordings, graphics and other digital assets the Photographer creates for the Client, including unused and unedited material. "Deliverables" means the final, edited Works supplied to the Client.
1.5 Where the Booking Confirmation differs from these terms, the Booking Confirmation applies.
1.6 By signing the Booking Confirmation or paying the deposit, the Client accepts these terms.
2. Bookings, fees and payment
2.1 A booking is confirmed once the Client has accepted the Booking Confirmation and paid the initial payment (the "deposit") of 25% of the booking fee. The deposit is non-refundable, except where clauses 3.4 or 4 apply.
2.2 The balance is due 48 hours before the shoot.
2.3 Fees are a flat rate, as stated on the Booking Confirmation.
2.4 Travel. Shoots more than 10 miles from the Photographer's base are charged at £0.50 per mile for the full return journey. Travel charges are shown on the Booking Confirmation or invoice.
2.5 Any other costs, such as parking, venue hire or props, are charged only if agreed in writing beforehand.
3. Cancellation and rescheduling by the Client
3.1 More than 7 days' notice. If the Client cancels more than 7 calendar days before the shoot, the deposit is kept by the Photographer and no further charges apply.
3.2 Within 7 days, or no-show. If the Client cancels within 7 calendar days of the shoot, or fails to attend, the deposit is forfeited.
3.3 Within 48 hours. If the Client cancels within 48 hours of the shoot, the deposit is forfeited and the Photographer may charge for loss of income, up to the full fee.
3.4 Rescheduling. If the Client asks to reschedule with at least 14 calendar days' notice, the Photographer may apply the deposit to a new date, subject to availability. The rescheduled session must take place within 1 calendar month of the original date.
3.5 A booking can be rescheduled once only. Any further date changes or postponements will incur a new deposit of 15% of the shoot fee.
3.6 A request to reschedule with less than 14 days' notice is treated as a cancellation under clauses 3.2 and 3.3.
4. If the Photographer can't attend
4.1 If illness, emergency or circumstances beyond the Photographer's control prevent the Photographer from attending, the Photographer will provide a suitable replacement photographer at no extra cost to the Client.
4.2 If no suitable replacement can be found, the Client may choose a new date or receive a full refund of all payments made for that booking.
4.3 The Photographer's total liability for any booking is limited to the fees paid for it.
5. Copyright
5.1 The Photographer is the author and owner of copyright in all Works under the Copyright, Designs and Patents Act 1988. Commissioning or paying for the Works does not transfer copyright.
5.2 Copyright stays with the Photographer unless the Client buys a Full Copyright Assignment under clause 7.
5.3 Raw files, unused images and outtakes are not supplied and are not covered by any licence unless agreed in writing.
6. Your licence (included in the fee)
6.1 Once all invoices are paid, the Client receives a non-exclusive, non-transferable licence to use the Deliverables as set out below.
6.2 Portraits, headshots and personal branding. For as long as the Client wishes, anywhere in the world, on their website, online profiles, organic social media, email signatures, CVs, speaker bios, press features about them, and personal prints.
6.3 Events, brand content and business work. For 12 months in the UK, unless the Booking Confirmation states otherwise, on the Client's website, organic social media, newsletters, internal communications and PR.
6.4 Event guests. The Client may share event images with speakers, guests or partners who appear in them, for their own personal or organic social use, with credit. Sponsors and partners who want to use images in their own marketing need their own licence.
6.5 The included licence does not cover paid or boosted advertising, print, outdoor or broadcast advertising, packaging or merchandise, use outside the licensed period or area, or use by third parties. These need an upgrade under clause 7.
7. Licence upgrades
7.1 Wider rights are priced as a percentage uplift on the fee.
The total is a flat rate: the fee plus the uplift. Travel is charged separately under clause 2.4
7.2 Exclusive licences and copyright assignments take effect only once confirmed in writing, signed by the Photographer, after full payment. An assignment excludes raw files
and unused images unless listed in it.
7.3 Upgrades can be bought at any time. If bought after delivery, they're priced at the
Photographer's rates at that time.
7.4 For large campaigns, national advertising or multi-year use, the Photographer
may quote a fixed rights fee instead of a percentage.
8. What the images can't be used for
8.1 Unless the Client holds a Full Copyright Assignment, the Client must not:
-
sell, sublicense or give the Works to anyone else to use commercially;
-
use the Works outside the licensed use, period or area;
-
enter the Works into competitions or awards without written consent;
-
register the Works, or any part of them, as a trade mark or logo;
-
use the Works to train or prompt AI tools, or create AI-generated versions of them;
-
apply edits or filters that materially change the Works or misrepresent the Photographer's work (normal cropping for layout is fine).
8.2 Under every licence, the Works must not be used in a way that is unlawful, defamatory or that shows anyone featured in a misleading or sensitive context.
8.3 Agencies, designers or printers working for the Client may handle the Works only to produce the Client's licensed materials.
9. Portfolio, privacy and credit
9.1 Under every licence, including a Full Copyright Assignment, the Photographer may use the Works on their website, social media, portfolio, award entries and marketing.
9.2 If the Client needs confidentiality (for example an unreleased product or embargoed launch), or wants specific images kept private, they must say so in writing before the shoot. The Photographer will respect this.
9.3 For personal sessions, the Photographer will ask before sharing any image that shows the Client in a private setting, in line with section 85 of the Copyright, Designs and Patents Act 1988.
9.4 Events. The Client is responsible for telling guests that photography is taking place, for example with a notice at the entrance or in the invitation. The Photographer will not publish images of anyone who asks not to be photographed, where told on the day.
9.5 Credit. Where practical, the Client will credit "Photo: Compton Harry Photography" or tag @comptonharryphotography. Leaving out a credit in paid adverts, or where the layout doesn't allow it, is not a breach.
9.6 The Photographer asserts the right to be identified as the author of the Works under sections 77 and 78 of the Copyright, Designs and Patents Act 1988.
10. Delivery and files
10.1 Edited images are delivered by online gallery by the date on the Booking Confirmation.
10.2 The Photographer keeps a copy of the Deliverables for 12 months after delivery. After that, re-supply isn't guaranteed and may be charged.
11. Payment and unauthorised use
11.1 No licence takes effect until all invoices for the booking are paid in full. Until then, any use of the images is unlicensed.
11.2 Use beyond the licence bought (wider use, a longer period, a wider area or use by third parties) will be invoiced at 200% of the fee for the licence that would have covered it. Paying this doesn't waive the Photographer's other rights, including claims for copyright infringement.
12. People, property and third-party content
12.1 The Client is responsible for permission to photograph its premises, staff, products and any location it arranges.
12.2 The Photographer will obtain model releases where agreed on the Booking Confirmation. Otherwise, the Client is responsible for any claim from people featured in the Works when used commercially.
12.3 The Client confirms that any logos, artwork, music or materials it supplies may lawfully be used, and will cover any claims arising from them.
13. Law and contact
13.1 These terms are governed by the law of England and Wales. If any clause is found invalid, the rest continue in full force.
13.2 Questions, upgrades, rescheduling and privacy requests must be made in writing to
